These Terms of Service (“Terms”) govern your access to and use of CallPilot, an AI-powered call handling service operated by Skyrise Digital, LLC (“Skyrise Digital,” “we,” “us,” or “our”). By accessing, subscribing to, or using CallPilot, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the service.
1. Description of the Service
CallPilot is an AI-assisted call handling service designed to answer incoming telephone calls, provide responses to common business-related questions, capture caller information, and optionally transfer calls based on preferences defined by the customer.
CallPilot is a communication support tool and is not a telecommunications carrier or phone service provider. CallPilot does not provide phone service, calling plans, or network connectivity.
CallPilot is a support tool only. It does not replace human decision-making, professional judgment, or legal responsibility. CallPilot does not provide legal, medical, financial, or professional advice, and does not make outbound calls or automatically schedule appointments.
CallPilot is currently designed to understand and communicate primarily in English. We do not guarantee accurate responses, lead capture, or call handling for callers who speak languages other than English, or whose accents, dialects, or speech patterns may not be accurately interpreted by automated systems.
2. Service Modifications
Skyrise Digital reserves the right to modify, update, suspend, or discontinue any feature, functionality, or component of CallPilot at any time, with or without notice.
We shall not be liable for any modification, suspension, or discontinuation of any part of the service.
3. Eligibility and User Responsibilities
You must be at least 18 years old and legally capable of entering into a binding agreement to use CallPilot.
You are solely responsible for your use of CallPilot and for ensuring compliance with all applicable laws, including those related to call forwarding, call recording, and consent requirements.
4. Acceptable Use
You agree not to use CallPilot for unlawful, harmful, deceptive, abusive, or fraudulent purposes. Skyrise Digital reserves the right to suspend or terminate accounts that violate these restrictions.
5. Call Recording, Transcription, and Monitoring
CallPilot records incoming calls and generates transcripts for operational, quality assurance, security, and service improvement purposes.
By using CallPilot, you represent and warrant that you have the legal authority to forward calls and to comply with all applicable call recording and consent laws.
Skyrise Digital is not responsible for your compliance with such laws.
Calls and transcripts may be reviewed when necessary for troubleshooting, quality improvement, legal compliance, or protection of our systems.
Skyrise Digital is not responsible for the accuracy, legality, or content of any information provided by callers.
6. Data Handling and Third-Party Services
CallPilot relies on third-party infrastructure providers to process calls, recordings, and AI responses.
We do not sell customer or caller data.
Service performance may depend on third-party systems, and Skyrise Digital is not responsible for outages or failures caused by those providers.

7. Subscription, Free Trial, Billing, and Usage
Each paid subscription applies to a single business location and includes one (1) dedicated AI forwarding number used behind the scenes to operate CallPilot. Customers may continue using their existing business phone number by forwarding calls to CallPilot.
New customers may receive a seven (7) day free trial. No payment method is required to begin the free trial.
Before CallPilot is activated, customers must submit accurate and complete required setup details through the onboarding form. Setup may be delayed if submitted information is incomplete, inaccurate, or requires clarification. By submitting the onboarding form, you agree that Skyrise Digital may contact you by email and phone using the contact information you provide for service-related purposes, including setup questions, activation support, trial assistance, usage updates, free trial reminders, subscription reminders, and notices related to continuing or ending your CallPilot service.
Setup and configuration of CallPilot is typically completed within an estimated one to two (1-2) business days after the onboarding form is submitted.
AI call minutes are measured based on CallPilot system and third-party provider records and may include time spent answering, handling, processing, or transferring calls through CallPilot.
The free trial begins when Skyrise Digital sends the customer’s CallPilot activation email. The free trial includes up to 60 AI call minutes. If the 60-minute trial limit is reached before the seven (7) day trial period ends, Skyrise Digital may pause, restrict, or deactivate the trial unless the customer begins a paid subscription.
The free trial does not automatically convert to a paid subscription. To continue using CallPilot after the free trial ends, or after the trial minute limit is reached, the customer must complete the paid subscription checkout and provide a valid payment method.
After the customer begins a paid subscription, the subscription will renew on a recurring monthly basis unless canceled prior to the next billing date.
Paid subscriptions include 250 AI call minutes per monthly billing cycle. Any usage beyond the included amount will be billed at a rate of $0.50 per additional minute and charged on the customer’s next recurring billing date.
Customers may cancel a paid subscription at any time to prevent future billing. Upon cancellation after a paid billing cycle has begun, service will remain active until the end of the current billing period unless otherwise determined by Skyrise Digital.
Except as expressly stated in these Terms, payments are non-refundable and partial or prorated refunds are not provided for unused time, unused minutes, or cancellations made after a billing cycle has begun.
8. Free Trial
CallPilot may offer a one-time seven (7) day free trial for new customers.
No credit card or payment method is required to begin the free trial. The free trial begins when Skyrise Digital sends the customer’s CallPilot activation email.
The free trial includes up to 60 AI call minutes. The free trial ends seven (7) calendar days after the activation email is sent, or when the 60-minute trial limit is reached, whichever occurs first.
Setup and activation are typically completed within one to two (1-2) business days after the customer submits the required onboarding form. The setup period occurs before the free trial begins.
By submitting the onboarding form and beginning the free trial process, you agree that Skyrise Digital may contact you by email and phone during the setup and free trial period for service-related purposes. These communications may include setup questions, activation instructions, support reminders, trial usage updates, free trial ending reminders, subscription reminders, and information about how to continue using CallPilot after the free trial.
The free trial does not automatically convert to a paid subscription. To continue using CallPilot after the free trial ends or after the trial minute limit is reached, the customer must complete the paid subscription checkout and provide a valid payment method.
If the customer does not begin a paid subscription after the free trial ends or after the trial minute limit is reached, Skyrise Digital may pause, restrict, deactivate, or delete access to the customer’s CallPilot assistant and related services.
Free trials are limited to one per customer, business, or location, unless otherwise approved by Skyrise Digital.
Skyrise Digital reserves the right to modify, deny, revoke, limit, pause, or discontinue free trial offers at any time, including in cases of suspected abuse, duplicate accounts, excessive usage, misuse, fraud, operational risk, or violation of these Terms.
9. No Guarantees; Service Limitations
CallPilot is provided on an “as is” and “as available” basis.
We do not guarantee uninterrupted service, perfect accuracy, or that all calls will be answered or handled in a specific manner.
You acknowledge that CallPilot may fail to answer or properly handle calls due to technical limitations, system errors, third-party failures, or other factors beyond our control.
Skyrise Digital shall not be responsible for missed calls, lost leads, lost customers, or business outcomes resulting from the use of the service.
10. Account Suspension and Termination
Skyrise Digital reserves the right to suspend, restrict, terminate, or refuse service to any account at any time, with or without notice, at our sole discretion and for any lawful reason.
This includes, but is not limited to, situations involving suspected abuse, unlawful activity, misuse of the service, operational risk, technical concerns, non-payment, excessive resource usage, or behavior that may negatively impact our systems, reputation, or business operations.
Skyrise Digital may also pause, restrict, deactivate, or delete access to a free trial if the trial period expires, the included trial minutes are used, required setup information is incomplete or inaccurate, the customer does not complete activation steps, or the customer does not begin a paid subscription after the trial.
You may cancel a paid subscription at any time, and cancellation will prevent future billing.
If Skyrise Digital terminates or cancels your subscription without cause and while your account is otherwise in good standing, we may provide a prorated refund for the unused portion of the current billing period at our sole discretion.
Upon termination or cancellation, access to CallPilot and associated services may be suspended immediately.
11. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including but not limited to outages, infrastructure failures, or natural events.
12. Limitation of Liability
To the maximum extent permitted by law, Skyrise Digital shall not be liable for any indirect, incidental, or consequential damages, including lost revenue, missed calls, or business interruption.
Our total liability shall not exceed the amount paid by you in the thirty (30) days preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Skyrise Digital from any claims arising out of your use of CallPilot or violation of these Terms.
14. Arbitration and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms, CallPilot, your account, billing, free trial participation, or use of the service shall be resolved by binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies.
The arbitration shall be administered by the American Arbitration Association (“AAA”) under its applicable rules. If the dispute is considered a consumer dispute, the AAA Consumer Arbitration Rules shall apply. If the dispute is considered a business or commercial dispute, the applicable AAA commercial rules shall apply. The applicable AAA rules and procedures will govern the arbitration except where they conflict with these Terms.
The arbitration shall take place in Florida, unless the parties agree to conduct the arbitration by telephone, video conference, written submissions, or another remote method allowed by the applicable arbitration rules.
The arbitrator shall have the authority to resolve all disputes relating to the interpretation, applicability, enforceability, or formation of these Terms, including any claim that all or part of these Terms is void or voidable.
You and Skyrise Digital agree that any dispute shall be brought only on an individual basis. Neither party may bring a claim as a plaintiff or class member in any class action, collective action, consolidated action, private attorney general action, or representative proceeding.
You and Skyrise Digital each waive the right to a jury trial and the right to have any dispute resolved in court, except for claims that may be brought in small claims court as described above.
If any part of this arbitration or class action waiver section is found to be unenforceable, the remaining portions shall remain in effect to the fullest extent permitted by law.
Judgment on the arbitration award may be entered in any court with proper jurisdiction.
15. Modifications to Terms
We may update these Terms at any time by posting a revised version on our website or otherwise providing notice. Continued use of CallPilot after the updated Terms become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Florida.
