These Terms of Service (“Terms”) govern your access to and use of CallPilot, an AI-powered call handling service operated by Skyrise Digital, LLC (“Skyrise Digital,” “we,” “us,” or “our”). By accessing, subscribing to, or using CallPilot, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the service.
1. Description of the Service
CallPilot is an AI-assisted call handling service designed to answer incoming telephone calls, provide responses to common business-related questions, capture caller information, and optionally transfer calls based on preferences defined by the client.
CallPilot is a communication support tool and is not a telecommunications carrier or phone service provider.
CallPilot is a support tool only. It does not replace human decision-making, professional judgment, or legal responsibility. CallPilot does not provide legal, medical, financial, or professional advice, and does not make outbound calls or automatically schedule appointments.
CallPilot is currently designed to understand and communicate primarily in English. We do not guarantee accurate responses, lead capture, or call handling for callers who speak languages other than English, or whose accents, dialects, or speech patterns may not be accurately interpreted by automated systems.
2. Service Modifications
Skyrise Digital reserves the right to modify, update, suspend, or discontinue any feature, functionality, or component of CallPilot at any time, with or without notice. We may also add new features, remove existing features, or make changes necessary for operational, security, or technical reasons.
We shall not be liable for any modification, suspension, or discontinuation of any part of the service.
3. Eligibility and User Responsibilities
You must be at least 18 years old and legally capable of entering into a binding agreement to use CallPilot. You are solely responsible for all activity conducted through your account and for ensuring that CallPilot is used in compliance with all applicable laws, regulations, and industry requirements.
You are responsible for ensuring that your use of call forwarding, call recording, and automated call handling complies with all federal, state, and local laws, including consent and disclosure requirements.
4. Acceptable Use
You agree not to use CallPilot for unlawful, harmful, deceptive, abusive, or fraudulent purposes. This includes, but is not limited to, harassment, impersonation, unlawful solicitation, abusive telemarketing practices, or any activity that violates applicable telecommunications or consumer protection laws. Skyrise Digital reserves the right to suspend or terminate accounts that violate these restrictions.
5. Call Recording, Transcription, and Monitoring
CallPilot records incoming calls and generates transcripts for operational, quality assurance, security, and compliance purposes. By using CallPilot, you represent and warrant that you have the legal authority to forward calls to CallPilot and to consent to call recording on behalf of your business.
Calls and transcripts are accessible only to Skyrise Digital and are not shared with third parties outside of service infrastructure providers necessary to operate CallPilot. Calls are not actively monitored or reviewed unless required for troubleshooting, service improvement, legal compliance, abuse prevention, or protection of Skyrise Digital’s rights and interests.
You acknowledge that callers may provide information, statements, or content during calls that are outside the control of Skyrise Digital. Skyrise Digital is not responsible for the accuracy, legality, or appropriateness of any information provided by callers during calls handled by CallPilot.
Skyrise Digital is not responsible for any failure by you to comply with call recording or consent laws applicable to your jurisdiction.
6. Data Handling and Third-Party Services
Skyrise Digital does not sell customer data or caller information. We do not intentionally retain caller information beyond what is necessary to provide the service.
CallPilot relies on third-party platforms and infrastructure providers to process calls, recordings, and AI-generated responses. Service availability and performance may depend on these third-party systems, and Skyrise Digital is not responsible for outages, interruptions, or failures caused by third-party providers. By using the service, you consent to such third-party processing strictly for service delivery purposes.

7. Subscription Plans, Billing, and Usage
Each subscription applies to a single business location and includes one (1) dedicated AI phone number. Each AI phone number is intended for use by a single user and a single destination phone number. Multiple users, shared use, multiple destination phone numbers, or simultaneous routing to multiple phones are not permitted under a single subscription. Attempts to bypass or violate these limitations may result in suspension or termination of service without refund.
Phone numbers provided as part of the service remain the property of Skyrise Digital or its telecommunications providers and may not be transferred, ported, or reassigned by the customer without written permission.
The initial onboarding, configuration, and setup of CallPilot—typically completed within one to two (1–2) business days—is included in your first monthly subscription payment. Your subscription term begins on the date of your first successful payment, not upon completion of onboarding or delivery of your AI phone number.
Plans include a monthly allocation of voice minutes. If usage exceeds the included minutes, additional minutes are billed at the applicable overage rate. Calls will continue uninterrupted during overages, and applicable overage charges will apply.
All fees are non-refundable except as expressly stated in these Terms.
8. Satisfaction Guarantee and Refunds
Skyrise Digital offers a one-time 30-day satisfaction guarantee for new customers. If you are dissatisfied for any reason, you may request a full refund within 30 days of your initial purchase. This refund includes subscription fees and any overage charges incurred during that period. No questions asked.
Refunds are not available after the 30-day period.
9. No Guarantees; Service Limitations
CallPilot is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted service, perfect accuracy, or that all calls will be answered or handled in a particular manner.
AI-generated responses may be incomplete, inaccurate, or misinterpreted, including due to language limitations, accents, background noise, call quality, or non-English speech. You acknowledge that automated systems are inherently imperfect and agree that you remain solely responsible for your business communications and outcomes.
Skyrise Digital does not guarantee that CallPilot will operate without interruption, delay, or error, and service availability may be affected by internet connectivity, telecommunications networks, third-party providers, or other factors beyond our control.
To the fullest extent permitted by law, Skyrise Digital disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Account Suspension and Termination
Skyrise Digital reserves the right, in its sole discretion, to suspend or terminate any account at any time if we determine that continued use of the service presents operational, legal, reputational, or business risk. This includes, but is not limited to, misuse of the service, abusive behavior, excessive support demands, violations of these Terms, or conduct we determine to be inappropriate, harmful, or disruptive.
We may suspend or terminate accounts with or without prior notice where reasonably necessary to protect the integrity, security, or operation of the service.
You may cancel your subscription at any time by submitting a written cancellation request via email or through the contact method designated on our website.
Upon termination or cancellation, your access to CallPilot may be disabled and associated service functionality may cease. Any outstanding charges or overage fees incurred prior to termination remain payable.
11. Force Majeure
Skyrise Digital shall not be liable for any delay, interruption, or failure to perform any obligation under these Terms if such delay or failure results from causes beyond our reasonable control. These causes may include, but are not limited to, acts of God, natural disasters, telecommunications failures, internet outages, power outages, infrastructure provider failures, labor disputes, government actions, or other events outside our reasonable control.
During any such event, the performance of affected services may be suspended for the duration of the event and for a reasonable recovery period thereafter.
12. Limitation of Liability
To the maximum extent permitted by law, Skyrise Digital shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, missed calls, lost customers, or business interruption, arising out of or related to your use of CallPilot.
In no event shall Skyrise Digital’s total liability exceed the amount paid by you to Skyrise Digital during the thirty (30) days preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Skyrise Digital, its owners, officers, employees, contractors, and affiliates from any claims, damages, liabilities, losses, or expenses arising out of your use of CallPilot, your business operations, or your violation of these Terms.
14. Arbitration Agreement and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of CallPilot shall be resolved exclusively through binding arbitration conducted in the State of Florida, unless otherwise required by applicable law, in accordance with the rules of the American Arbitration Association.
You agree that any dispute shall be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You waive any right to participate in a class action or jury trial.
You understand and agree that, by accepting these Terms, you are waiving the right to a trial by jury.
15. Modifications to the Terms
Skyrise Digital may modify these Terms at any time. Continued use of CallPilot after changes are posted constitutes acceptance of the updated Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
